Bryan Basso represents both plaintiffs and defendants, ranging from startups to Fortune 100 companies, in complex patent and trade secret litigation. He has successfully tried and managed cases through all phases of litigation in courts across the country. He also provides analysis and counseling to clients faced with a variety of nonlitigation patent issues.
Bryan has represented clients in many venues across the U.S., including a number of U.S. District Courts like the Northern Districts of California, Illinois, and Ohio, the Eastern Districts of Texas and Michigan, the Central District of California, the Western District of Texas, as well as the Districts of Delaware, Massachusetts, and Utah. He also represents clients before the U.S. International Trade Commission and at the U.S. Patent and Trademark Office.
With a background in electrical engineering, Bryan’s practice encompasses a wide range of products and technologies, including, for example, semiconductor design and fabrication, mobile devices and displays, microprocessors, FPGAs, memory, optical communications, graphics cards, software, navigation systems, networking, medical devices, consumer products, sports equipment, graphics cards, satellite communications, and power supplies.
His broad litigation experience includes all aspects and phases of cases from pre-suit investigations to fact and expert discovery, claim construction, dispositive motion practice, trial, post-trial briefing, and appeal. He also represents both patent owners and petitioners in inter partes review proceedings, as well as assists clients with trade secret litigation, ITC litigation, design patent litigation, and patent due diligence. He is experienced in crafting strategy and advising clients facing disputes in multiple venues and litigation phases, all in a coordinated way that accomplishes his clients’ goals.
Clients also rely on Bryan for analysis and counseling outside of litigation in connection with licensing, large-scale patent due diligence, patent risk assessment, monetization, and in the context of other business transactions and opportunities.
Before joining Fish, Bryan gained technical and legal experience with Novell. As a software tester, he designed, programmed, and automated software testing in a variety of environments. As a legal extern, he worked on open-source licensing, copyright compliance, invention disclosure policies, and other intellectual property issues. In law school, he served as an arbitrator at Brigham Young University’s Center for Conflict Resolution.
