Background

Brian Gaff is a lead litigator in high-stakes intellectual property disputes, particularly patent infringement matters. An experienced trial lawyer, Mr. Gaff mediates and arbitrates IP disputes, handles Markman hearings, evidentiary and dispositive hearings, motion practice, and discovery. Clients also rely on Mr. Gaff to handle their copyright, trademark, trade secret litigation matters and license disputes, including matters involving allegedly infringing source code and website content.

A principal in Fish’s Boston office, Mr. Gaff has litigated cases in numerous jurisdictions across the U.S, as well as before the U.S. Court of Appeals for the Federal Circuit.

Mr. Gaff is a highly versatile lawyer with well-honed research and analytical skills. As a certified electronic discovery specialist, he advises clients regarding preventative measures to limit exposure to electronic discovery.

For more than 18 years, Mr. Gaff has counseled clients on patent and intellectual property rights in connection with financing, mergers and acquisitions, and other business transactions, and has helped clients obtain hundreds of patent and trademark applications in the U.S. and internationally.

Prior to pursuing a career in law, Mr. Gaff worked as an engineer at Draper Laboratory, Siemens, and Hewlett-Packard Company. Mr. Gaff is a licensed professional engineer in four states.
