Georgia v. Public.Resource.Org, Inc.

Supreme Court to Review Copyrightability of State’s Official Code Annotations

Georgia v. Public.Resource.Org, Inc., No. 18-1150 (U.S. cert grant June 24, 2019) (11th Cir.: MARCUS, Hull, Bucklew) (N.D. Ga.: Story) (5 of 5 stars)

Supreme Court grants the State of Georgia’s certiorari petition from the 11th Circuit’s determination (906 F.3d 1229 (11th Cir. 2018)) that the annotations contained in a state’s official annotated code are not copyrightable. The question presented is:

  1. Whether the government edicts doctrine extends to—and thus renders uncopyrightable—works that lack the force of law, such as the annotations in the Official Code of Georgia Annotated.
