Supreme Court grants Dex Media’s petition for certiorari from the Federal Circuit’s decision (899 F.3d 1321 (Fed. Cir. 2018)) vacating an IPR written decision and remanding for dismissal due to time-bar. The Supreme Court’s grant of certiorari is limited to question 1 of Dex Media’s petition:

  1. Whether 35 U.S.C. § 314(d) permits appeal of the PTAB’s decision to institute an inter partes review upon finding that § 315(b)’s time bar did not apply.
