Appointments Clause Challenge to CBM Decision Waived If Not Briefed

Fed Cir construes Rule 28(j) letters as motions to vacate CBM written decisions in view of Arthrex, No. 2018-2140, slip op. (Fed. Cir. Oct. 31, 2019), and denies those motions. Movant-patent owner Customedia forfeited any relief on Arthrex-type grounds (i.e., asserting an Appointments Clause challenge to the PTAB panel issuing the decision) by not including it in its opening brief. Appointments Clause challenges are not jurisdictional, and may be waived, and the opinion cites Island Creek Coal, 910 F.3d 254 (6th Cir. 2018), and Turned Bros., 757 F. App’x 697 (10th Cir. 2018).
