At their heart, trademarks identify the source and quality of goods and services and protect their owners’ investments in the goodwill represented by their marks. But they also serve as an important consumer protection measure. Without properly-controlled trademark use, consumers could be harmed by selecting inferior or dangerous products bearing trademarks that are identical or confusingly similar to those used with legitimate products. Unfortunately, the COVID-19 crisis has led to a troubling uptick in trademark infringement schemes that are designed to mislead the public into purchasing ineffective or potentially dangerous products.
