In 2016, the Patent Trial and Appeal Board (PTAB) was the most active forum for patent validity challenges in the U.S. With inter partes review (IPR) and post-grant review (PGR) proceedings rising since the America Invents Act, what has changed in post-grant practice, and how do those changes impact your IP strategy globally? This interactive session will include discussion about post-grant practice and will attempt to answer your questions - including, for example, whether post-grant is an appropriate tool for you, and what to do if one of your patents is the subject of a post-grant petition. The session will also address recent developments that impact the scope and frequency of institution, recent decisions, treatment of PTAB decisions by the Federal Circuit, and what the future is likely to hold.
