The Supreme Court recently agreed to review Helsinn Healthcare v. Teva Pharmaceuticals, which involves the issue of whether a private sale of an invention (where the details of the invention itself are kept confidential) qualifies as “prior art” under the America Invents Act (AIA) and thereby can be used to invalidate later patents.
