Fish is proud to support the Federal Circuit Bar Association, whose mission is to assist in improving and facilitating the administration of justice in the Circuit’s community. With an active membership and committee structure, the Association fosters local, regional, national, and international engagement. In addition to practice, policy, and professional skills outreach, the Association supports the community through a variety of pro bono channels, media offerings, scholarships, and other service. Leadership comes from all areas of the practice community.

This panel will discuss the latest developments in PTAB practice, including evolving strategies in view of discretionary denials such as ex parte reexamination and joinder calculus, IPR estoppel scope and timing, and interplay between claim construction positions in litigation and IPRs. This panel will also explore PTAB-specific appellate issues such as jurisdiction.
