Autumn Wu advocates forU.S. and Chinese clientsin patent litigation at the International Trade Commission (ITC) and in U.S. district courts, with a focus onmedical devices, life sciences, consumer electronics, and mechanical arts.
Autumn has extensive experience in litigating high-stakes Section 337 investigations at the ITC, where she has represented both complainants and respondents and provided strategic counseling across all phases of litigation, from pre-suit diligence through trial and appeal.In district courts, she has advocated for leading consumer electronics manufacturers as well as life sciences companies developing small-molecule drugs, biosimilars, and medical devices.
A native Mandarin speaker, Autumn is particularly well equipped to help Chinese companies chart a course through the U.S. legal system and position themselves to achieve favorable outcomes in their complex IP disputes. She also brings technical versatility to her work, having a background in bioengineering and a diverse practice that touches on technologies from pharmaceuticals to engineering.
Autumn's notable experience includes securing a judgment in favor of respondent Guangzhou Rebenet in a trade secret misappropriation matter at the ITC. Autumn’s critical contributions also helped a major consumer electronics company obtain summary judgment of non-infringement in two highly technical patent infringement matters in district courts.
Experience
Certain Foodservice Equipment and Components Thereof, 337-TA-1166 – Represented respondent Guangzhou Rebenet in a case involving trade secret misappropriation, as well as tortious interference with contractual relationships. Complainants sought a limited exclusion order at the ITC to bar importation of the client’s products into the United States. Obtained a final judgment that complainants failed to prove substantial injury to domestic industry.
Certain Vacuum Insulated Flasks and Components Thereof, 337-TA-1216 – Represented respondent Everich and Tomic Houseware Co., Ltd. in a Section 337 action brought by Hydro Flask and Helen of Troy Limited alleging design patent infringement and trademark infringement. Case resolved via consent order.
Represented a plaintiff pharmaceutical company in Hatch-Waxman actions involving a blockbuster non-opioid analgesic for postsurgical pain. After pursuing patent infringement claims in multiple U.S. District Courts and an appeal to the Federal Circuit, the parties settled all claims resulting in the generic delaying a complete launch for nearly fifteen years. Shares of our client’s stock surged upon the announcement of the settlement.
Secured a favorable settlement for a biopharmaceutical company in litigation related to the company’s oral testosterone therapy formulation.

Autumn provides pro bono legal assistance to Kids in Need of Defense (KIND) and the American Civil Liberties Union (ACLU).
She represented the EDGAR Association in a patent dispute over the organization’s system for detecting unusual play patterns indicative of cheating in the game of bridge. The U.S. District Court for the Northern District of Georgia granted Fish’s motion to dismiss at the Rule 12 stage, finding, invalidating two patents asserted by Hammond Software, Inc. on Section 101 grounds.
