Preservation of Appellate Arguments and Considerations for Appellate Review of PTAB Decisions

Circuit Judge Timothy Dyk of the U.S. Court of Appeals for the Federal Circuit will join us to discuss his recently released book, Timothy B. Dyk: The Education of a Federal Judge, and share his thoughts on the evolution of the PTAB and appellate review of PTAB decisions. This panel will discuss considerations in how to formulate inter partes review arguments with an eye towards appellate review, how to "appeal-proof" an IPR, and how to capitalize on varying standards of appellate review.
