An accomplished patent and commercial litigator, Joseph Warden has represented both plaintiffs and defendants in some of the largest and most impactful cases, especially in the field of life sciences.

Joseph has extensive courtroom experience and an impressive record of success in high-stakes cases, both at trial and on appeal. He excels in every aspect of litigation, from opening statements, discovery, witness examination, cross-examination, and dispositive motions through trial and appeal. He has prevailed for clients in courts across the nation, including the Northern District of California, the District of Delaware, the Eastern District of Virginia, and the Delaware Court of Chancery.

For instance, he represented Gilead Sciences Inc. in its infringement suit over hepatitis C drug patents, securing a reversal of a $2.5 billion damages award, the highest-figure patent damages award in history. He also helped stave off infringement claims from entities such as Idenix Pharmaceuticals LLC and Merck & Co., winning a reversal of a $2.5 billion jury verdict against his client.

Joseph’s experience spans a variety of technologies, including life sciences, medical devices, computer software, and electronics. He enjoys wrangling challenges at the convergence of complex science and law and transforming complicated matters into easy-to-understand and persuasive arguments for lay jurors and judges.

Before joining Fish & Richardson, Joseph clerked for the Honorable Kent A. Jordan of the U.S. Court of Appeals for the Third Circuit.
