Prosecution & Counseling

The proliferation of digital content has placed the Digital Millennium Copyright Act (DMCA) at the forefront of many companies’ copyright counseling needs. The DMCA, intended to protect service providers and copyrighted content in this age of digital distribution, is the focus of ongoing interpretation. Much attention has been drawn to the DMCA’s anticircumvention provisions, which make it illegal to disable copy-protection devices on digital content. The DMCA’s safe-harbor protection for Internet service providers against copyright infringement claims also continues to be a controversial topic.

We know how to handle the legal and technical issues that confront clients who create, distribute, and use digital content, devices, and systems in both transactional and litigation settings. We regularly assist clients with DMCA notices and takedowns and perform audits on social media and websites to identify potential infringers.
