Post-Grant for Practitioners: Post-Grant Appeals

This webinar has ended.

With a new director at the USPTO (who now has the authority to review PTAB decisions) and major post-grant reform legislation introduced in Congress, 2022 marks a new era in post-grant law. However, ongoing disputes - specifically those concerning estoppel, obviousness, and the reviewability of PTAB institution decisions - continue to be major issues in post-grant jurisprudence. The Federal Circuit has issued several rulings on these topics that will have major implications for practitioners.

On Wednesday, November 2, please join Fish attorneys John Dragseth and Nitika Gupta Fiorella for a review of important Federal Circuit decisions in 2022. The panelists will discuss hot-button cases concerning the substance and process of PTAB appeals at the Federal Circuit and provide practical insights for your day-to-day practice. Topics are expected to include:

  • The latest on estoppels coming into and out of post-grant proceedings and how they affect strategy and tactics at the USPTO and in district court
  • Updates on what is reviewable (and what is not) from post-grant proceedings
  • What’s new in the law on obviousness
