Fed Cir denies petitions for panel rehearing and for rehearing en banc.

Judge Stoll did not participate.

Dissent: Judge Newman would have granted the petition for rehearing en banc. In her view the PTAB’s reconsideration of its institution decision post-remand did not comply with the Fed Cir’s remand order, which “raises critical issues of agency authority, judicial responsibility, and the constitutional plan.” Dissent at 3.
