Overview

Joseph Warden is an accomplished patent and commercial litigator who has represented both plaintiffs and defendants in some of the most significant and high-stakes cases in the U.S., particularly in the life sciences sector. 

A first-chair trial lawyer, Joseph has served as lead counsel in major litigations involving life sciences, medical devices, semiconductors, and other complex technologies. He also has deep experience in patent damages, with a track record of outstanding success representing both accused infringers and patent holders in damages trials. For example, in a damages-only trial defending a major pharmaceutical company after a liability finding, Joseph convinced the jury to award less than 10% of the multi-billion dollar damages sought by the plaintiff. In another case involving medical devices, he achieved a jury award amounting to less than 2% of the damages sought. On the patent holder side, Joseph has led damages cases resulting in eight-figure jury verdicts and nine-figure settlements. 

Joseph is also an experienced appellate advocate and has successfully represented clients in both federal and state appellate courts. Outside of the office, Joseph enjoys playing the piano and spending time with his kids.

Pro bono activities

A strong advocate for pro bono service, Joseph has represented clients in cases involving capital punishment, First Amendment rights, prison reform, and more. He has built lasting relationships with pro bono organizations, through which he has paired young attorneys with opportunities for meaningful stand-up courtroom experience. More than a dozen Fish & Richardson attorneys have examined their first trial witness in a pro bono case under Joseph’s guidance gaining invaluable litigation experience while delivering critical legal services to underserved clients.
