Overview

Jared Smith has extensive experience in intellectual property litigation, with an emphasis on patent litigation in the consumer electronics sector. His practice includes litigation in both U.S. District Court and the U.S. International Trade Commission across a diverse array of technologies, including cybersecurity, consumer electronics, medical devices, and energy storage systems.  

Jared has experience in all phases of litigation, from pre-suit diligence through trial and post-trial. He excels at managing cases and developing strategies on claim construction, non-infringement, and invalidity. 

Before joining Fish & Richardson, Jared was a senior systems engineer at Raytheon for six years, where he helped develop the Ship Self Defense System for U.S. Navy aircraft carriers. He also worked at Northrop Grumman for two years, where he helped develop an IP-based communications system for the U.S. Navy’s Triton unmanned aerial vehicle. Jared leverages his engineering experience throughout his legal practice. For example, he uses his understanding of developing complex systems and working on engineering teams to efficiently guide the process of discovery of relevant technical facts and documents during litigation.  
 
Jared is a lifelong backpacker and he enjoys hiking and camping with his wife and two boys. More recently, Jared has been training and competing in Brazilian Jiu Jitsu.  He enjoys the physical and mental challenges that the martial art provides.  

Pro bono activities 

Jared serves as the pro bono coordinating attorney for Fish's San Diego office. He frequently provides pro bono services through San Diego Volunteer Lawyer Program, an organization dedicated to serving the most vulnerable members of society. Through SDVLP, Jared has represented low-income tenants with a wide range of issues, including negotiating additional time and relocation assistance after receiving eviction notice, stopping impermissible rent increases, recovering improperly withheld security deposits, and investigating billing issue regarding shared utilities. In 2018, SDVLP honored him with its Pro Bono Publico Award (i.e., lawyer of the year). 

Case work 

  • Represented a minority woman with multiple severe impairments who had been denied Social Security disability benefits. Jared’s persistent advocacy over multiple years resulted in his client being paid over two years’ worth of wrongfully denied benefits, amounting to more than $25,000. 

  • Represented multiple asylum seekers at the U.S. Court of Appeals for the Ninth Circuit after their applications were denied by the Department of Homeland Security. In the most recent case, Jared represented a man from Honduras who had been tortured and nearly executed. Jared prepared all the briefings and delivered the oral arguments for the appeal before a panel of three judges. The Ninth Circuit found that DHS committed legal error in denying asylum and remanded the case for further proceedings. DHS subsequently dropped the case, and Jared’s client is no longer under threat of deportation.
