Patents are a vital tool for protecting market share in the life sciences industry. Patent term extension (PTE) via the Hatch-Waxman statute can add enormous value to a pharmaceutical franchise, particularly because the product is often at its revenue peak at the end of the patent term, when every day of added protection can be worth millions of dollars. To maximize such benefits, patent prosecutors must understand the nuances of the PTE statutory provisions along with the importance of coordinating efforts with regulatory affairs professionals early in the product development process.
