Unither Pharma, Inc. et al. v. Daily Wellness et al.; Herbalife International, Inc. v. Unither Pharma, Inc. – (N.D. Cal.) Represented Unither Pharma, Stanford University, and New York Medical College in enforcing patents relating to the use of L-arginine to provide beneficial cardiovascular effects. Case settled.

Kyphon Inc. v. Disc-O-Tech Medical Technologies Ltd. et al. – (D. Del.) Represented Kyphon in enforcing patents relating to kyphoplasty, a minimally invasive spine procedure for treating vertebral compression fractures. Case settled after jury found that Defendants infringed Kyphon’s patents.

Fresenius Medical Care Holdings, Inc. et al. v. Baxter International, Inc. et al. – (N.D. Cal.) Represented Fresenius Medical Care Holdings, Inc. and Fresenius USA, Inc. in a declaratory judgment patent non-infringement and invalidity action against Baxter involving hemodialysis systems. Obtained jury verdict that all claims at issue were invalid.

Massachusetts Institute of Technology et al. v. ImClone Systems, Inc. – (D. Mass.) Represented Repligen Corporation and MIT in enforcing a patent related to technology for genetically engineering mammalian cells for enhanced production of valuable proteins. Case settled.

Sandu et al. v. Medtronic Sofamor Danek, Inc. et al. – (W.D. Tenn.) Represented Kyphon Inc. in enforcing Kyphon’s patents relating to kyphoplasty, a minimally invasive spine procedure for treating vertebral compression fractures, and represented Dr. Sandu in the same suit for inventorship and trade secret misappropriation claims against Medtronic. Case settled after Medtronic acquired Kyphon.

Repligen Corp. et al. v. Bristol-Myers Squibb Company – (E.D. Tx.) Represented Repligen and University of Michigan in enforcing a patent related to treating rheumatoid arthritis. Case settled.

Boston Scientific Corporation v. Medtronic Vascular, Inc. et al. – (N.D. Cal.) Represented Plaintiff-Intervenor Boston Scientific Corporation in a declaratory judgment action against Medtronic and evYsio Medical Devices ULC. The patents at issue related to cardiovascular stents. Case settled.

Baxter Healthcare Corp. et al. v. Fresenius Medical Care Holdings, Inc. et al. – (N.D. Cal.) Defended Fresenius against Baxter and DEKA in a patent infringement suit involving peritoneal dialysis systems.  Obtained jury verdict of non-infringement.
