Patent Enforcement: Licensing and Litigation

Companies frequently use technology developed and patented by academic and research institutions without first entering into a licensing agreement. As a result, the institution loses revenue and fails to be recognized for its inventive contribution. Many institutions have little recourse against these infringing companies because they lack the financial and legal resources necessary to pursue legal action.

We offer a variety of alternative fee options, including arrangements where Fish covers all legal fees and costs to pursue licensing or litigation. These arrangements allow institutions to recover lost revenue without financial risk.

How It Works

Step 1: Contact Fish
Your institution can start the process by contacting Fish and identifying the relevant patents and the companies that may be using the patented technology. Fish will then conduct a preliminary assessment of the matter without any obligation (financial or otherwise) from your institution.

Step 2: Enter an Engagement
If the matter is suitable for enforcement, your institution will discuss and enter into an engagement agreement with Fish. Next, Fish will perform a more in-depth review of the matter and develop enforcement strategies for your consideration.

Step 3: Enforce Your Patents
After your institution evaluates and selects an appropriate strategy, Fish will begin enforcing patents. Your institution always retains control over the enforcement effort and full settlement authority. In many cases, Fish will be able to resolve the dispute through licensing discussions. Sometimes, however, licensing attempts fail and litigation is necessary. Each year for the past decade, Fish has handled more patent litigation than any other firm. Should litigation ensue, Fish has the experience to achieve a great result for your institution.
