Background

Indranil (“Indy”) Mukerji is a Principal in Fish & Richardson’s Washington D.C. office.  His practice focuses on litigating and trying complex patent cases in federal courts and tribunals around the country in a wide variety of technologies, including electrical and computer software and hardware.

Mr. Mukerji proudly represents a who’s-who of the world’s leading tech companies, against both competitors and non-practicing entities (NPEs).  He has handled dozens of significant cases in courts nationwide (e.g., Texas, California, Virginia, Illinois, and Delaware), including as lead counsel.  His cases have involved a variety of technologies, including: semiconductors, operating systems, wireless networking, data storage/hard disk drives/tape storage, memory/dynamic random access memory (DRAM), consumer electronics, enterprise security systems, network identity management, e-commerce methods and systems, unified communications, liquid crystal displays (LCDs), software licensing protocols and product activation, mass data storage systems, interrupt processing, and online payment systems.  He also has been involved in cases implicating various important technical standards, and is experienced in handling the unique issues that go along with litigating standards essential patents (SEPs).

An engineer and registered patent attorney, Mr. Mukerji also has counseled clients and managed division- and company-wide patent and IP portfolios for clients ranging in size from start-ups to global corporations.  He brings that experience to bear in advising companies on the strategic nexus between prosecution, licensing, and litigation, a nexus that is emerging as a critically important one in light of the procedures made available at the U.S. Patent and Trademark Office over the past several years (for example, inter partes review).

In 2011, the National Law Journal named Mr. Mukerji as the only patent litigator on its national “Minority 40 Under 40” list.  Super Lawyers has named him as a “Super Lawyer” (2016) and “Rising Star” for successive years (2013, 2014) and Lawyers of Color has named him to its “Power 100” list of the nation’s most influential minority attorneys for successive years (2014, 2015).

Prior to joining Fish & Richardson, Mr. Mukerji served as the managing partner of an intellectual property boutique, and he practiced IP law at a large Boston law firm before that.  He has lectured at Cornell University’s School of Engineering on professional ethics and practice, and at the Boston University School of Law regarding intellectual property trial advocacy.
