Background

Joe Herriges is an Associate in the Twin Cities office of Fish & Richardson. He represents both plaintiffs and defendants in patent litigation across the country in a variety of technology areas, including pharmaceuticals, business methods, retroreflective optics, medical devices, and mechanical engineering issues related to off-road vehicles.

Mr. Herriges has experience in all major aspects of litigation, including pre-suit investigations, fact and expert discovery, claim construction, summary judgment, bench and jury trials, post-trial proceedings, and appeal. He has taken and defended numerous depositions, and successfully argued motions, including non-dispositive and dispositive motions, and for preliminary injunctive relief. Mr. Herriges has also briefed and argued an appeal on behalf of a pro bono client, successfully persuading the court of appeals to reverse the district court’s sentencing order.  Mr. Herriges is also experienced in inter partes review proceedings before the Patent Trial and Appeal Board.

Prior to joining the firm, Mr. Herriges served as a law clerk to Judge Michael J. Melloy on the U.S. Court of Appeals for the Eighth Circuit.  At the University of Minnesota, he was member of the varsity swim team and was named Academic All Big Ten.
