Prosecution & Counseling

Patent law is unique among all other areas of law, and patent appeals are singular in the world of appellate practice. Patent appeals go to the Federal Circuit and present a mix of the most complicated facts and technology, the deepest procedural intricacies, and the most nuanced law of any field. That makes them particularly exacting to frame. No other firm understands those challenges like Fish, which employs more than two dozen former Federal Circuit clerks, and has more big victories in recent years in patent appeals than any firm in the country.

Fish clients hire us for high-end leading-edge work. Not only do our clients stick with us when an appeal is necessary, many of them hire us to handle appeals in cases other firms have lost.

In addition to protecting billion-dollar innovations, Fish has also been instrumental in shaping patent law. Through our work at the Federal Circuit and the Supreme Court of the United States, Fish is driving important changes in patent law and helping create new legal standards that protect intellectual property rights. The sheer breadth of our cases gives us a unique ability to identify the best cases that can lead to these changes, to spot important legal trends earlier, and to best position cases for appeal. Our highly-regarded amicus curiae counsel is frequently requested, and our attorneys have filed numerous amicus briefs in these courts.

Our legal team has represented world-renowned brands in appellate courts, including Microsoft, LG Electronics, Gilead Sciences, Halo Electronics, and many other prominent companies. In 2018, Fish led more oral arguments (26 total) and won more cases (17 total) at the Federal Circuit than any other firm. Fish has won 30 precedential decisions at the Federal Circuit since January 1, 2018. Fish has argued 15 Federal Circuit cases and won seven between January 1 to July 31, 2019.

The National Law Journal put Fish on their prestigious Appellate Hot List for the eighth year in 2019.
