PTAB Clears The Way For Easier AIA Review Amendments

​Principal Lawrence Kolodney was asked to comment on last week’s order by an expanded panel of the Patent Trial and Appeal Board that set guidelines that attorneys say should make it easier to amend patents in American Invents Act reviews.

"What the board is doing here is putting a more common-sense gloss on its original statement, which, if interpreted broadly, could impose a really impossible burden on patent owners,"

He added that the message to patent owners is that amendments to fix patents in AIA reviews "are not a purely hypothetical possibility; they are a practical reality. Patent owners should not be discouraged from attempting to amend claims by what had appeared to be the high bar set by the Idle Free decision."
