New Litigation Leader Discusses AIA and IP Strategy with Law360

Kurt Glitzenstein, Fish’s new leader of the litigation group, spoke withLaw360 about the America Invents Act and its profound impact on how Fish’s litigation group has shifted the way it prepares for patent litigation over the last several years.

“One thing that really stands out as a a common denominator in litigation is the role and prevalence of post-grant challenges involving patents,” he said. “After the enactment of the AIA, post-grant proceedings have become an integral part of both offensive and defensive litigation strategy.” Mr. Glitzenstein went on to discuss Fish’s strategy: “Attorneys from Fish’s litigation group and patent group take an integrated approach when filing aninter partes review…with the patent group often taking the lead in drafting the petition and litigators handling aspects more akin to cases in district court, like depositions and oral hearings before the Patent Trial and Appeal Board.” To read the entire piece, click here.
