Fish principal Craig Countryman recently authored an article for the Daily Journal regarding the “dual sovereign” doctrine. Despite the Constitution’s double jeopardy clause that prohibits a defendant from being prosecuted twice for the same offense, a defendant can be independently prosecuted under both federal and state law under the doctrine. In the article, Craig examines how the doctrine was started and the reasons that may prompt the U.S. Supreme Court to do away with the dual sovereign doctrine as it hears Gamble v. United States within the next few months.
