Catherine Stockell (Of Counsel) was quoted in the Law360 article, “Kiss Frontman Unlikely To Get ‘Horns’ Gesture Trademark ” on June 14, 2017.

“Mr. Simmons’ claim to possess proprietary trademark rights in a version of an iconic ‘rock ‘n’ roll salute’ known as the ‘hand horns’ could hit a sour note,” said Catherine H. Stockell, a trademark attorney with Fish & Richardson PC.

First, there’s the obvious point that variations on the “horns” gesture have been widely used for decades by many people who aren’t Simmons, including numerous other rock stars during the “live performances” for which Simmons is seeking to register it.

That’s a fairly big deal when it comes to trademark law, which hinges on how much consumers associate a mark with a particular source of goods or services.
