Fish & Richardson assists clients in the computer software industry in obtaining
protection via patents and copyrights and in licensing and other transactions. We have
experience with all types of software from operating systems to a wide variety of industrial
and consumer application programs.
We have extensive experience in prosecution of software patent applications. Our
clients include multinational software and hardware vendors, a range of small enterprises
and start-ups, and individual inventors. Subjects include computer networks, parallel
processing, optimization algorithms, voice recognition, imaging, operating systems, and
user interfaces.
We have implemented copyright registration programs in the United States and have
advised on international protection of software via copyright and trade secret laws.
We have counseled clients on validity and infringement of software patents in diverse
fields, including computer networks, CASE and CAD systems, windowing, operating systems,
industrial and consumer application programs, image processing, graphics, FAX, general
ledger accounting and modem control.
Our software licensing experience has included ongoing, across-the-board representation
of software and database suppliers and individual projects for other clients. We have
drafted and negotiated agreements for development and distribution of application programs
and databases, and have drafted and reviewed shrink-wrap licenses. Our licensing work has
included source code licensing and negotiation of source code escrow arrangements.
We compiled a compendium of packaged software licensing agreements in 1988 that remains
a primary source of model agreements for the software industry.
We have a proven track record in software patent infringement litigation. We
represented Adobe Systems, Inc. in Quantel, Ltd. v. Adobe Systems, Inc., chosen by
The National Law Journal as one of the most significant defense verdicts of 1997. The
Adobe victory was one of only 15 verdicts named as most notable by the National Law
Journal, and the only patent litigation victory to make the list. Adobe was sued by
Quantel, Ltd., a U.K. company, in the U.S. District Court in Wilmington, Delaware.
Adobe faced not only potential damages of $138 million, with possible trebling, but
also the risk of an injunction stopping the company from selling one of its flagship
products, Adobe Photoshop®. A jury decided in favor of Adobe on every issue that had
been raised at trial.
