The Delaware Court of Chancery has long been recognized as the nation’s leading business court. It has been lauded for its expedited handling of complex business disputes, its stellar judiciary, the consistency and predictability of its decisions (perhaps due to a lack of juries), and its ability as a court of equity to mete out fair and creative forms of relief, as well as damages. Recently, the Court’s jurisdiction was expanded to include the litigation, mediation, and arbitration of a broad array of patent, technology, and contract-related disputes. Since then, the Court of Chancery has become the court of choice for a growing number of technology-related disputes. The economic crisis of the past year and resulting corporate downsizing have spawned an increasing number of trade secret, non-competition, and nondisclosure cases.
