Sony Electronics, Inc. v. Guardian Media Technologies, Ltd., __F.3d __ (Fed. Cir. 2007)

 

The Federal Circuit vacates district court’s dismissal for lack of subject matter jurisdiction, faulting the district court for focusing on the lack of a threat (explicit or implicit), given the change in the law from MedImmune v. Genentech, 127 S.Ct. 764 (2007). It did not matter that Guardian was always willing to enter a business resolution.
