The AIPLA, an industry organization representing about 15,000 IP lawyers in the US, recently wrote a letter to the EPO making recommendations on fee amounts associated with renewing an Unitary Patent. In the letter, the AIPLA warned that US users are not likely to increase European patent budgets in order to obtain Unitary Patents. In an interview with Managing Intellectual Property, Fish Principal John Pegram, who took part in the AIPLA’s previous consultation with the EPO, stated, “It is not like the old days when IP offices set their fee schedules and said ‘take it or leave it.’ There is a choice here. Does Europe want the Unitary Patent system to be successful?”
