​Principal Ryan McCarthy was featured in the article "Go Track ‘Alice’" by the Texas Lawyer discussing the new "Alice Tracker" online resource for IP practitioners, launched by Fish & Richardson.

"As the Alice decision came out last year, it’s hit software [litigation] pretty hard," McCarthy said, especially the busy administrative courts within the U.S. Patent and Trademark Office. "The Supreme Court … didn’t really provide good guidance on how it should be applied. There’s a lot of confusion," he said.

Fish’s long list of IP clients wanted to know what the case may do to their claims—especially in the patent-heavy Eastern District of Texas—so McCarthy decided he might as well alert the rest of the world when important Alice decisions come out.

"We’ve decided to open it up. So if you’re in the Eastern District, it will either give you a warm fuzzy or a prickly feeling" about a patent claim, he said. "There’s a ton of these Alice cases coming out. Some are more important than others. We’ve taken those cases that provide important information and filter it based on judge and court or judgment or issue."
