Agilent Technologies, Inc. v. Kirkland: Delaware Court of Chancery Provides Guidance on Pleading Claims for Unfair Competition, Tortious Interference with Prospective Business Relations, and Violations of the Delaware Deceptive Trade Practices Act


The jurisdiction of the Court of Chancery was expanded in 2003 to cover a broader array of technology disputes. Since then, Delaware entities heavily invested in their intellectual assets have significantly increased their use of the Court of Chancery, widely known for its swift and consistent handling of business disputes. In February 2009 alone, Delaware entities filed a rash of technology actions seeking damages and injunctive relief to protect their intellectual assets. These actions were for misappropriation of trade secrets, theft of confidential corporate information, and violations of noncompete, nonsolicitation, or licensing agreements.
