FCC Announces Environmental Review of Antenna Structure Registration Program

The Federal Communications Commission (FCC) has announced that it will conduct a Programmatic Environmental Assessment (PEA) to evaluate the potential impact of its Antenna Structure Registration (ASR) program.  This proceeding will likely have a significant impact on tower construction and registration because it will affect the pre-construction review and environmental processing for towers nationwide.

Under the ASR program, owners of certain antenna structures must notify the Federal Aviation Administration and register their towers with the FCC.  The FCC is under a federal court mandate to revise its ASR public notice procedures because of the significant environmental effect on migratory birds caused by the construction of communications facilities.  The FCC must provide greater public notice of proposed individual tower applications so that environmental groups and other interested parties can petition the FCC for further environmental review before the towers are constructed.

The FCC has established a website, http://www.fcc.gov/pea, which contains information and documents relating to the PEA and which will allow interested parties to submit written comments.  Comments are due January 14, 2011.  A draft PEA is anticipated by Spring 2011, followed by public meetings in Spring/Summer 2011, and a final PEA in Summer 2011.
