Litigation attorney Seth Sproul was recently interviewed by Corporate Counsel about the Federal Trade Commission’s October 6 findings and recommendations for new rules and requirements for patent assertion entities (PAEs).

Transparency seems to be a big issue in the report. The FTC is recommending more disclosure of entities with a financial interest in the litigation. Do you think that would be a helpful reform?

“It’s the sort of information we find titillating, for lack of a better word, but the utility of it in actual litigation I think is uncertain. The identity of investors simply may not be a meaningful data point for a judge or jury, even though we find it interesting. It’s possible the investor could be the dentist friend of the patent holder down the road. In my experience you can often get that disclosure in discovery.”
