Principal Kristen McCallion is quoted in Law360‘s article “3 Trademark Cases To Watch In The 2nd Half Of 2015” in regards the Federal Circuit case of Simon Tam and his band, The Slants, who were refused a trademark registration on the ground that the name was disparaging to a substantial number of Asian-Americans.

“Intellectual property and constitutional attorneys alike will be watching this case,” said Kristen McCallion. “Ultimately, we could wind up with a circuit split, which may result in this question being before the Supreme Court,” McCallion said. “The ramifications of a finding that this section of the Lanham Act violates the First Amendment would be both broad and interesting.” Oral arguments are set for October.
