Often used as a forum for patent infringement suits, the International Trade Commission (ITC) is becoming a more attractive venue for trademark owners seeking remedies against parties who import counterfeits and other infringing goods into the United States. Fish’s Sheryl Koval Garko and Monty Fusco discussed best practices and strategies for both trademark owners who are thinking about using the ITC to enforce trademark rights, as well as accused infringers who have found themselves in this fast-paced forum, including:
