The Federal Circuit in Therasense v. Becton Dickinson narrowed the range of situations that can lead to a finding of inequitable conduct by a patent owner or a patent attorney. Yet a duty to disclose material information remains, and the Patent Office has not addressed its pre-Therasense Rule 56 on duty to disclose.
