Making Sense of Therasense: What You Need To Know About Inequitable Conduct Today

The Federal Circuit in Therasense v. Becton Dickinson narrowed the range of situations that can lead to a finding of inequitable conduct by a patent owner or a patent attorney. Yet a duty to disclose material information remains, and the Patent Office has not addressed its pre-Therasense Rule 56 on duty to disclose. At this session, an experienced litigator and an experienced prosecutor will discuss Therasense with a special focus on its practical effect on litigated patent cases and on day-to-day patent prosecution.
