The buzz continues in the biotech and pharmaceutical industries after the U.S. Supreme Court’s recent decision in Prometheus v. Mayo and the court’s subsequent remand of the Myriad gene-patenting case back to the Federal Circuit. The justices declared all of Prometheus’ claims for diagnostic methods patent-ineligible, unanimously reversing the Federal Circuit. Post-Prometheus, discovering and claiming indicative correlations is an impermissible attempt to monopolize a natural phenomenon, or a law of nature, unless the claim contains other features that add something beyond a statement of the correlation.
