Will Fee Shifting Help or Hinder Patent Enforcement?

Monday, March 2, 2015
6:30pm – 8:30pm
Greenberg Lounge, Vanderbilt Hall – New York University

Please join us at 6:30 PM (Greenberg Lounge, Vanderbilt Hall) on March 2 for a panel discussion of the pros and cons of the current legislative proposal n H.R. 9 that the patent litigation loser should pay the winner’s attorney’s fees and costs. Professor Jason M. Schultz (Professor of Clinical Law, NYU Law) will moderate a discussion on the role of fee shifting as a deterrent to abusive litigation and whether the proposed fee shifting is needed in view of the relaxed standard for exceptional case recovery since the SCOTUS decision in Octane and Highmark. Our distinguished speakers are Eric C. Cohen (Katten Muchin Rosenman LLP), John M. Desmarais (Desmarais LLP), Rochelle C. Dreyfuss (Pauline Newman Professor of Law, NYU Law), Theresa M. Gillis (Mayer Brown LLP), David J. Kappos (Cravath, Swaine & Moore LLP), and John B. Pegram (Fish & Richardson). A reception will follow at 7:45 PM.

1.5 New York CLE credits in the Area of Professional Practice is approved for both experienced and newly admitted attorneys (those admitted to the New York Bar for less than two years) and is presented in traditional (in person) format.
