What Your Business Needs to Know About Copyright:
DMCA Anti-Circumvention and Trafficking Provisions

Wednesday, March 2, 2011
1:00 pm – 2:00 pm EST
Copyright Webinar Series

Join us for a discussion on the anti-circumvention and trafficking provisions of the Digital Millennium Copyright Act (DMCA), which make it a violation of federal copyright law to circumvent technology that controls access to copyrighted works and to traffic in technology that makes circumvention possible.

The DMCA is the subject of rapidly developing case law, and this topic is of vital interest to software companies that wish to understand and take advantage of the additional remedies the DMCA offers, as well as any company that makes after-market or software-compatible products.

Key Topics:

  • The DMCA Anti-Circumvention Provision – What is “circumvention” and what does it prohibit; notable recent cases imposing liability, including MDY v. Blizzard (9th Cir.)
  • Liability for Trafficking – What circumvention technologies and methods are banned under the “trafficking” provisions; who can be liable for “trafficking”; what liability attaches to technologies that have both legitimate and prohibited uses
  • Remedies, Litigation, and Procedural Issues – Scope of civil and criminal penalties for violations; preliminary and permanent injunctions; administrative exemptions from liability; territorial scope of DMCA and indirect liability
  • Recommendations – How you can take advantage of the additional protections offered by the DMCA; how to avoid liability under the DMCA and relationship to reverse engineering; what to expect from further case law and legislative developments

Speakers:

Heidi E. Harvey, Of Counsel, Boston, MA
Adam Kessel, Associate, Boston, MA
