What types of Medical and Diagnostic Method Claims are Patent-eligible?

Join us for an examination of the holdings in Myriad and Prometheus, two cases that impact the patentability and enforceability of method claims. We will evaluate the Federal Circuit’s application of the “machine-or-transformation” test and discuss how the court’s opinions and analysis shed light on the patentability of method claims in the fields of biotechnology and medicine. We will also provide suggestions for drafting various types of method claims and patent specifications in light of recent guidance from the Federal Circuit and USPTO.
