Brian Wacter is a Principal in the Southern California office of Fish & Richardson P.C. Brian prepares, prosecutes, and secures patent protection for his clients' innovations, with an emphasis on computing, communications, and electrical engineering. He also litigates and tries cases in courts throughout the country. Additionally, Brian provides intellectual property counseling, including advice on infringement and validity, portfolio due diligence analysis, and formal opinions.

Brian previously served in the United States Air Force for eight years as a Communications Officer. His duties included planning and support for global communications systems and secure networks. He also worked on communications platforms employed by aircraft including the F-15E, ABCCC, AWACS, and Joint STARS. Brian also has significant technical experience in commercial industry, including work as a Senior Applications Engineer, Technical Lead for Cypress Semiconductor.

Litigation examples
AVID Identification Sys., Inc. v. Philips Semiconductors Inc. - No. 2:04-cv-183 (E.D. Tex.). Member of trial team that represented AVID in a two-week trial asserting patent infringement (3 patents) and Lanham Act claims relating to RFID transponders and readers. Obtained favorable mid-trial settlement from two defendants and a complete jury victory against the other two defendants, including a finding of willful infringement and a damages award of over $6 million.

Microsoft Corp. v. Lucent Technologies, Inc. - No. 03-CV-0699 B (S.D. Cal.) Defend Microsoft in patent infringement case involving 15 patents in various technologies, including audio, speech, and video compression, remote graphics communication, stylus-based user interfaces, on-screen tools, and communication protocols.
