Professional experience
Joshua Pond is an Associate in Fish & Richardson’s Washington, D.C. office. His practice emphasizes intellectual property counseling, including all aspects of patent litigation. He has experience with pre-suit investigations, district court Markman hearings and jury trials, International Trade Commission (ITC) investigations and trials, expert witness discovery and testimony, electronic discovery, patent portfolio analysis and acquisition, patent licensing and negotiations, as well as patent prosecution and reexamination proceedings before the U.S. Patent and Trademark Office.
Prior to law school, Mr. Pond served as an artillery officer in the United States Marine Corps (1994-2001).

In the Matter of Certain Video Displays, Components Thereof, and Products Containing the Same (International Trade Commission Inv. No. 337-TA-687, 2009) – Representing Complainant LG Electronics against Respondents Vizio and Funai in patent infringement and importation investigation related to LCD and plasma displays.
LG Electronics, Inc. v. Hitachi, Ltd. (E.D. Texas 2007) - Represented LG Electronics as plaintiff and defendant against Hitachi in series of infringement cases involving 17 patents related to plasma display panels with $1b+ in combined sales, resulting in favorable settlement on eve of trial.
Aloft Media LLC v. Microsoft Corp. et al. (E.D. Texas 2008) – Represented defendant SAP in patent infringement case related to software for collaborative supply chain decision making.
Premier International Associates LLC v. Microsoft Corp. et al. (E.D. Texas 2007) – Representing defendant LG Electronics MobileComm in patent infringement case related to media download management. Successfully obtained stay of litigation pending reexamination of patents-in-suit.
In the Matter of Certain Unified Communications Systems, Products Used With Such Systems, and Components Thereof (International Trade Commission Inv. 337-TA-598, 2007) - Represented Complainant Microsoft against Respondent Alcatel-Lucent in patent infringement and importation investigation and trial related to computer telephony and unified messaging. Administrative Law Judge found infringement and validity.
International Manufacturing and Engineering Services Company, Ltd. v. Semiconductor Energy Laboratory Company, Ltd. (D. District of Columbia 2006) - Represented defendant Semiconductor Energy Laboratory (SEL) in unfair competition and injurious falsehood case related to organic light-emitting diode technology. District court granted SEL’s motion to dismiss.
Antor Media Corp. v. Nokia, Inc. et al. (E.D. Texas 2005) - Represented defendant LG Electronics MobileComm in patent infringement case related to media downloading to mobile phones. Successfully initiated ex parte reexamination of patent-in-suit, resulting in stay of litigation.
Cargill, Inc. v. Canbra Foods Ltd., Dow Agrosciences Canada Inc., and Dow Agrosciences LLC. (D. Oregon 2003) - Represented plaintiff Cargill in complex jury trial related to high stability canola oil, resulting in determination of infringement, patent validity, and damages.
Patent counseling examples
Counseling co-founders of sporting goods startup on patent matters, including prosecution, product clearance, licensing, and portfolio strategy; negotiated license of startup’s patents to competitor.
Counseled $15b/year multinational business software corporation on $10m multi-patent acquisition to augment portfolio for offensive and defensive assertion against competitor, including comprehensive technical and legal analysis of initial 56 patents, as well as business strategy analysis of final seven purchase candidates in partnership with economics expert.
Counseled Web company with over 100m hits per month on numerous patent acquisitions, including in-depth due diligence on claim scope and validity.
