Professional experience
Cynthia Walden is a Principal in the Boston office of Fish & Richardson P.C. and heads the firm's Trademark and Copyright Group. Her practice includes all aspects of trademark law, ranging from U.S and foreign prosecution, client counseling, domain name and Internet-related issues, trademark dilution, trademark opposition and cancellation proceedings before the Trademark Trial and Appeal Board, and trademark litigation. Ms. Walden's practice also includes copyright
prosecution, client counseling, and copyright litigation. She has extensive experience with false-advertising and unfair competition matters, and with corporate due diligence.
Representative cases
National Basketball Ass'n v. Motorola, Inc. - 105 F.3d 841 (2nd Cir. 1997) Represented Motorola in a suit for copyright infringement and commercial misappropriation arising out of
pagers that track real-time NBA game statistics; Second Circuit found in favor of Motorola on all counts.
Toy Manufacturers of America, Inc. v. Helmsley-Spear, Inc. - 960 F.Supp. 673 (SDNY 1997) Represented Toy Manufacturers of America in trade dress and unfair competition suit against Helmsley-Spear arising out of the interference with and copying of method and location at which the annual TOY FAIR trade show is conducted; the Court issued a TRO and a preliminary injunction
in favor of Toy Manufacturers of America.
Southern Foods Group L.P. v. Ben & Jerry's Homemade, Inc. - 48 USPQ2d 1220 (D. Utah 1998) Represented Ben & Jerry's in defending against a preliminary injunction sought by Southern Foods regarding use of the ice cream flavor name TOTALLY NUTS; the Court denied the preliminary injunction.
Bose Corporation v. QSC Audio Products, Inc. - 293 F3d 1367 (Fed. Cir. 2002) Represented Bose Corporation in an appeal of a Trademark Trial and Appeal Board decision on an opposition of QSC's POWERWAVE mark for "electronic audio and video signaling equipment" based on the famous Bose WAVE and ACOUSTIC WAVE marks; the Federal Circuit reversed and ruled in favor of Bose, denying registration of POWERWAVE and holding the Bose WAVE and POWERWAVE marks to be famous marks.
