Charles Hieken is a Principal in the Boston office of Fish & Richardson P.C. His practice emphasizes all aspects of patents, trademarks, copyrights, proprietary information, related unfair
competition and antitrust law. He has prepared and prosecuted hundreds of patent
applications in various fields and trademark applications, as well as prepared and
negotiated numerous patent, trademark, copyright, and other license agreements.
He has also advised on numerous copyright matters. Mr. Hieken previously served as a law clerk with predecessor Fish, Richardson & Neave (1956-1957) and in private practice (1957-1987).

Trial and appellate experience includes preparing all briefs and petitions
in Aro I and Aro II in the U.S. Supreme Court; arguing Aro II, soliciting
and successfully enforcing Bose 901 loudspeaker patent, arguing Bose in
the U.S. Supreme Court, briefing and arguing trademark cases (Silenus
Wines and Alford Mfg. Co. v. Alfred Electronics in Court of Customs
and Patent Appeals, and Motorola v. Bose and Bose v. QSC in the Federal Circuit Court of
Appeals). Tried Alford v. United States in the U.S. Court
of Claims. Tried Bose v. LDL and briefed and argued in Second
Circuit Court of Appeals. Consultant in patent, trademark, and copyright
litigation.
Prosecution examples
Prosecution of patent applications in various fields include collision avoidance radar;
computers; inertial measurement devices
(accelerometers, gyros); guidance, navigation, and control technologies;
loudspeaker systems; numerous other complex electronic, electromechanical, mechanical, microwave,
antenna, semiconductor, headphone, and medical inventions. Prosecution of trademark and service
mark applications for wide range of goods and services, often overcoming repeated refusals to
register. Briefed and argued numerous cases before PTO Board of Patent Appeals and Interferences
and predecessors, and before Trademark Trial and Appeal Board.
