Professional experience
Alexander Harguth is a Principal in the Munich office of Fish & Richardson. Before joining the firm, Mr. Harguth was a partner at Bardehle Pagenberg in Munich, where he managed a diverse patent litigation practice that included advising clients on complex infringement proceedings in district and appellate courts and related parallel nullity and opposition proceedings. In addition to heading patent litigation cases, Mr. Harguth handles litigation and adversarial matters relating to design protection, unfair competition, trade secrets, and licensing. Mr. Harguth also provides counsel on all aspects of enforcing intellectual property rights through the strategic use of European border measures. In 1999-2000, Mr. Harguth served as legal counsel for the European Commission/DG XIII, Luxembourg, in connection with pan-European research and development projects subsidized by the EU.
Mr. Harguth has tried numerous significant multinational infringement cases involving technical areas that include medical, construction, automotive technologies and sports equipment, semiconductor technologies, as well as software-related inventions such as MP3 technologies, pharmaceuticals and cosmetics. Many of these cases involved multiple European jurisdictions. He has represented clients that include, inter alia, a world leader in the manufacturing of sports equipment, a highly regarded international dental equipment manufacturer, an international leader in cosmetic products, and a distinguished Swedish maker of automotive technologies. Mr. Harguth is fluent in English, German, and French.
Litigation examples
Represented a leading European producer of toxin-free adhesives used in energy-saving structures for buildings. After filing numerous parallel preliminary injunctions and lawsuits against several key players in the German building industry on behalf of his client, Mr. Harguth obtained a major settlement agreement. This enforcement led to an appreciable increase in production and revenue of the client.
Successfully enforced in a series of actions over the course of many years the most critical rights relating to the intellectual property of a world leader in sports equipment.
Strategically utilized European border measures for a well-known company involved in MP3 technology to facilitate numerous advantageous business transactions on behalf of the client.
