Fish & Richardson is pleased to be a key contributor to a new book, Navigating the Digital Age: The Definitive Cybersecurity Guide for Directors and Officers.  Published by the New York Stock Exchange and Palo Alto Networks, the book provides boards of directors, general counsel, and other corporate executives and officers with practical, expert advice on how to meet the challenges of preparing for, protecting against, and recovering from cyberattacks.

Fish contributed two chapters to the collection.  Co-authored by Gus Coldebella, leader of Fish’s cybersecurity practice and former acting General Counsel of the U.S. Department of Homeland Security, and Caroline Simons, who specializes in cybersecurity and government investigations, “Where Cybersecurity Meets Corporate Securities” explores the SEC’s expanding role as cybersecurity regulator, discusses tricky disclosure and securities regulation-related issues, and provides a framework for companies to think about whether, how, and when they should publicly disclose cybersecurity risks and cyberattacks.  “Protecting Trade Secrets in the Age of Cyberespionage” explores reasonable steps companies can take to prevent cybertheft of trade secrets and other intellectual property assets, to mitigate the harm of such thefts if they occur, and to use legal means to challenge competitors that use stolen IP to unfairly gain an advantage in the marketplace.
