IMRA America Inc. v. IPG Photonics Corp.
Defended IPG Photonics in a patent litigation matter related to rare earth-doped high power optical fiber lasers and amplifiers, such as for use in cutting, welding, and telecommunications. Jury verdict of non-infringement.

Certain Mobile Telephones and Wireless Communication Devices Featuring Digital Cameras and Components Thereof (337-TA-663)
Represented respondent LG Electronics in a patent case brought by Eastman Kodak. Case went to trial in Fall 2009 but the parties settled before a decision was issued by the Judge or Commission.

Kyocera Wireless Corp. et al. v. ITC (Nos. 2008-1355, -1377, -1383, -1423, -1424)
Fish represented LG Electronics MobileComm U.S.A., Inc. in both the underlying case at the ITC (as intervenor) and on appeal. Although the ITC ruled that certain Qualcomm baseband processor chips infringed, Fish was able to get an order that would exclude LG’s phones containing those chips from the US, and succeeded in convincing the Federal Circuit that the ITC exceeded its statutory authority, reversing a longstanding Commission practice to use limited exclusion orders to exclude non-parties’ downstream products that contain infringing components.

Colida v. Nokia America Corp. (231 F. App’x 961)
Fish successfully obtained dismissal of appeal of a pro se litigant who alleged infringement of his mobile telephone design patents by Fish client Nokia

Certain Unified Communications Systems, Products and Components Thereof (337-TA-598)
Represented complainant Microsoft against Alcatel-Lucent in a case related to computer telephony and unified messaging. The Administrative Law Judge found infringement and validity.

DigaComm, LLC v. Vehicle IP, LLC, et al.
Fish was co-counsel to Vehicle IP, LLC and its CEO in an arbitration before the American Arbitration Association regarding a multi-million dollar fee dispute regarding licensing of certain patents. Obtained favorable post-arbitration decision.

Cricket Communications, Inc. v. HipCricket, Inc.
Fish represented Cricket Communications in a trademark infringement, dilution, unfair competition, and cybersquatting action relating to its CRICKET trademark. We obtained a favorable settlement through mediation shortly before trial.

Netcraft Corporation v. AT&T Inc., et al.
Represented plaintiff Netcraft in patent litigation involving Internet billing methods. Settled favorably.

Certain Baseband Processor Chips & Chipsets (337-TA-543)
Represented LG Electronics as intervenor in a patent case brought by Broadcom against Qualcomm accusing Qualcomm's baseband processor chips, which are components used in LG's cellular telephone handsets.

Wireless Agents, LLC v. Amoi Elecs., Inc., et al.

Represented Nokia in a patent infringement case involving handheld communications devices. The case was settled favorably.

Fenner Investments, Ltd. v. Juniper Networks, Inc., et al.

Represented Nokia in a patent infringement case involving mobile communications infrastructure equipment.

Siemens Business Communication Systems v. Harris Corporation

Represented Siemens in a patent infringement case relating to telecommunications switching equipment.

NICE Systems, Ltd., and NICE Systems, Inc. v. Witness Systems, Inc.

Trial counsel for Witness in a patent infringement claim involving 10 patents in the fields of telecommunications, voice recording, databases and storage, VoIP conferencing, and conference recording. The case was settled favorably after mistrial and related litigation.

William Reber, LLC v. Samsung Elecs. Am., Inc., et al.

Defended a patent infringement action relating to image capture cellular telephones. The case was settled favorably.

Light v. AT&T Wireless
Defended telecommunications company in defamation and invasion of privacy action. Obtained judgment of dismissal and award of costs.

Bellcore v. FORE Systems
Successfully defended FORE against an assertion of six patents relating to telecommunications technology. We won a summary judgment after claim construction. Chosen by the National Law Journal as one of the most significant defense judgments of 2000.

British Telecommunications v. Level 3 Communications
Defended Level 3 Communications in a multi-patent case brought by British Telecommunications in the United States District Court for the District of Delaware relating to methods of installing fiber optic cable. The case was settled.

Alcatel USA Inc. v. Tekelec Inc.
Represented Alcatel USA and obtained favorable settlement in patent infringement case involving telecommunications technology.

Bell Atlantic Network Services Inc. v. Covad Communications Inc.
Obtained summary judgment for Covad Communications, a customer of Nokia, in a hotly contested patent infringement case just prior to trial. The case involved digital subscriber line systems, including ADSL and SDSL platforms, carrierless amplitude phase modulation, discrete multi-tone modulation, and related DSLAM systems. The case was affirmed by the Court of Appeals for the Federal Circuit (2001).

Brooktrout v. Eicon Networks

Counsel for plaintiff Brooktrout in a patent infringement suit against Eicon concerning the automatic routing of faxes over a computer network. Obtained an injunction following a jury verdict that found patents valid and infringed.

AirDefense Inc. v. AirTight Networks Inc.

Lead counsel for AirDefense in a trade secrets case involving wireless network security systems and technologies. The case was settled favorably with consent injunction during discovery.

Digital Packet Licensing, Inc. v. MCI, Inc., et al.

Represented Time Warner Cable in a patent infringement case involving digital packet telephone systems and VoIP technology.

Cheetah Omni, LLC v. Level 3 Communications, Inc., et al.

Obtained stay of litigation pending reexamination of a patent on optical telecommunications switch technology.

Cisco Sys., Inc. v. Alcatel USA, Inc., et al.
Represented Alcatel in an antitrust case involving optical cross-connect technology.
